Terms of use · Porchly

These terms are an agreement between you and Porchly by Owais Builds (“Porchly”, “we”, “us”) about using the Porchly app and website. Please read them. By creating an account or using Porchly, you agree to them and to our privacy policy.

1. Who can use Porchly

You must be 18 or older and able to enter into a binding agreement. You may only have one account, and you’re responsible for what happens on it. Keep access to your email account secure, because that’s how you sign in.

2. What Porchly is

Porchly lets people give away items they no longer need and ask for items others are giving away. We provide the app; we don’t own, inspect, store, deliver or guarantee any item, and we are not a party to any exchange between users.

3. Free items only

Everything listed on Porchly must be free. You may not:

sell anything, ask for money, a deposit, a fee, a “small contribution”, a swap or any other payment for an item;
take payments through Porchly or arrange payment outside it for something found on Porchly;
use Porchly to advertise a business, a paid service or items for sale elsewhere.

Porchly never asks you to pay for an item. If someone does, please report them.

4. Prohibited items

You may not list, ask for or give away:

weapons of any kind, including firearms, parts, replicas, knives designed as weapons, and ammunition;
drugs, drug paraphernalia, and anything sold as a legal high;
alcohol;
tobacco, e-cigarettes, vapes and their liquids;
medicines, prescription or over-the-counter, and medical devices that require a prescription;
recalled products, including drop-side cribs and recalled car seats, and any used car seat past its expiry date;
animals, including pets and livestock;
adult or sexual content and products;
stolen goods, or anything you don’t have the right to give away;
counterfeit or replica branded goods;
hazardous chemicals, including pesticides, fuel, solvents and anything flammable, corrosive or toxic;
personal information, accounts, tickets or vouchers that can’t legally be transferred;
anything else that is illegal where you or the recipient are, or that breaks Google Play’s policies.

Before giving away baby gear, electricals or anything safety-related, check for recalls and make sure it is safe to use. We may remove any listing we believe breaks these rules, even if it isn’t on this list.

5. Your content

You keep ownership of the photos and text you post. You give Porchly a worldwide, non-exclusive, royalty-free licence to host, display, resize and distribute that content in order to run, promote and improve Porchly. This licence ends when you delete the content or your account, except for copies kept as described in our privacy policy (for example, content attached to a report).

You promise that your listings are accurate, describe any defects honestly, and that you have the right to post the photos and give the item away.

6. How you treat other people

Be honest and courteous. Do not harass, threaten, discriminate against, defraud or spam anyone, and do not use Porchly to contact people for any reason other than the exchange in front of you. Do not share someone else’s personal information, post exact addresses in a public listing, or try to get around blocks, rate limits or bans. Do not scrape, copy or interfere with the app.

7. Pickups are between users, at your own risk

Arranging and completing a pickup is entirely between the giver and the finder. You meet, collect and use items at your own risk. Porchly does not check items or users and cannot guarantee that an item is as described, safe, legal or that anyone will turn up. Please follow our safety tips, use your judgement, and report anything that seems wrong.

8. Porchly Plus

Porchly Plus is an optional auto-renewing subscription that adds features such as more saved searches, instant alerts, extra saved places and a wider search radius. Giving, asking, messaging, reporting and safety features are free and are never part of Plus.

Plus is billed by Google Play to the payment method on your Google account. The price and billing period are shown in the app before you subscribe.
Your subscription renews automatically at the end of each period unless you cancel it at least 24 hours before it renews.
You can cancel at any time in Google Play subscriptions. Plus stays active until the end of the period you’ve paid for.
Refunds are handled by Google Play under its refund policies, except where the law requires otherwise.
Deleting your Porchly account does not cancel your subscription.
We may change Plus features or prices in future. Price changes are notified by Google Play and apply from your next renewal.

9. Reports, moderation and termination

We may review reports, remove content, limit features, or suspend or close an account if we believe someone has broken these terms, put others at risk, or exposed Porchly to legal risk. Where it’s safe and practical, we’ll tell you why. You can stop using Porchly and delete your account at any time from You → Settings → Delete account.

If we close your account for breaking these terms, any Plus subscription is not refunded by us; cancel it in Google Play to avoid further charges.

10. Disclaimers

Porchly is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises about the app, listings, users or items, including that they are accurate, safe, fit for a purpose, or available without interruption or errors.

11. Limitation of liability

To the fullest extent the law allows, Porchly and its operator will not be liable for any indirect, incidental, special or consequential loss, or for any loss or harm arising from items, pickups, meet-ups or the conduct of other users. Our total liability to you for any claim relating to Porchly is limited to the greater of the amount you paid us for Porchly Plus in the 12 months before the claim, or USD 50.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.

12. Indemnity

If you break these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs, to the extent the law allows.

13. Changes to these terms

We may update these terms. If a change is important we’ll tell you in the app or by email before it takes effect. If you keep using Porchly after that, the new terms apply; if you don’t agree, please stop using Porchly and delete your account.

14. Governing law

These terms are governed by the laws of the jurisdiction where the operator is established, without giving up any mandatory consumer protections you have under the laws of the place where you live. Disputes may be brought in the courts of that jurisdiction or, where the law gives you the right, in the courts where you live.
